Training objectives

The main goal of the course is providing an elementary knowledge of the basic elements of Roman Private Law: family law, ownership and other rights in rem, obligations.

The main knowledges acquired by students will be:

- The evolution of private law in the the History of Rome
- The origins of modern private law
- Concepts and categories of private law

The basic abilities (i. e. the capacity of applying the acquired knowlwdge) will be:

- The skill in understanding the evolution of law in its historical development
- The skill in understanding the most important concepts regarding the study of private law

Prerequisites

Good knowledge of Italian language, sufficient skills of reasoning and learning abilities. The knowledge of Latin makes the learning easier, but it is not mandatory.

Course programme

The course forecasts 40 hours of teaching. It analyzes the historical evolution of Roman Private Law from the origins to the Justinian age:
- Subjects of law: legal capacity and capacity to act (2 hours)
- Family law: freeborn, citizen and slaves, the Roman family, marriage, the father’s power (8 hours)
- Legal facts and acts (6 hours)
- Ownership, possession, other rights in rem (12 hours)
- Obligations: the nature of obligation, general features of contracts, atypical contracts, agreements, quasi-contractual obligations, quasi-offence law, warranty obligations, discharge of obligations (12 hours)

Didactic methods

The course is organized in frontal lectures on all the topics of the program. Also active partecipation of students will be furthered: they will be required to take part into discussion about main legal institutes.

Learning assessment procedures

The exam consists of a oral test. The aim of the exam is to verify at which level the learning objectives previously described have been acquired. Students have to answer some questions on the topics regarding the course program. The final evaluation is established in connection with the examination results.
