Training objectives
- Il programma del corso è volto ad illustrare la complessa normativa che regola la contrattualistica del settore bancario e di quello assicurativo, evidenziando, in particolare, la disciplina dei rapporti con la clientela ed i principali contratti tipici ed atipici utilizzati nel relativo specifico settore.
Prerequisites
- Besides the examination of Civil law, it is useful to have overcome by Company law examination for a best understanding of the subject.
Course programme
- A first introductory part is devoted to the organization of the subjects "bank" and "insurance", furnishing a descriptive approach (notions, juridical nature and peculiarity of the bank and insurance areas; the sources of the discipline of the banking and insurance contracts).
The course deepens the peculiarities of the banking contracts, with particular reference to the principal typical contracts, “atypical” and contracts used in the routine of the business (The contracts for the harvest of the saving and the contracts for the disbursement of the credit.).
A third part underlines the principal contractual fattispecies used in the activity of the insurances, characteristics and categories. Didactic methods
- The course is facing to stimulate the student's involvement in the discussion of the theoretical problems, practical cases and of the close examinations that will be faced during the lessons.
Learning assessment procedures
- The confirmatory esamination will be orally. The examination is turned to verify the knowledge of the discipline of the banking and insurance contracts.
During the course it will be necessary the study of the Civil Code and aspects of the banking Unique Text (TUB: d. lgs. September 1° th 1993, n. 385) (v. on the site www.bancaditalia.it). It will be usefull also reading the Instructions of Vigilance for the banks (available on the site of the Bank of Italy www.bancaditalia.it). And the Insurance Code (DLvo 7/9/2005, n.209).
