Training objectives

The purpose of the course is provide the students with an in-depth knowledge of the main principles of Mass Media Law, with particular reference to press, television, internet and to the rules pertaining to the use of the means of communication in our system. Moreover the course aims to develop a critical ability to appraise the actuality, the legislation, the proposals of reform concerning the information, the means of communication, and the deontological rules of the journalists and public communicators. During the course, a particular attention will be reserved to the analysis of the recent reforms and case law.

Main knowledge acquired:
The students will acquire specific knowledge of the main principles and institutes of Mass Media Law:
- the constitutional foundations of the rights of expression and communication as well as theirs limits;
- the discipline of the main means of communication;
- the administrative organization of the public system of information and communication.

Main skills acquired.
By the end of the classes, the students will acquire the following skills:
- capacity to understand the constitutional foundations and the specific legislation of the rights and the public system of information and communication;
- capacity to understand the main critical aspects of Mass Media Law, also in the light of the praxis and the case law treated during the course.

Prerequisites

The students should have a good knowledge of Public Law.
The Study Plan ("Description of the training path - academic year 2022/2023", available on the website of the Department) provides, in order to be able to take the examination of Public Information Law, the following prerequisites: Constitutional Law, Private law institutions, European Union law.

Course programme

The first part of the course will be dedicated to the analysis and the interpretation of the constitutional rights (art. 15 and 21 Cost.). The second one will be focused on the reconstruction of the legal framework and on the application of the Mass Media rules in our system.
The course consists of frontal and practical lessons for a total of 40 hours. The program is divided in four parts:

PART I – Principles and fundamental rights (10 hours):
1) Constitutional principles of Mass Media Law;
2) Freedom of information and freedom of expression;

PART II – The sectors of Mas Media Law (10 hours):
1) The press;
2) The television;
3) Internet and electronic communication;

PART III – The transversal themes of Mass Media Law (10 hours):
1) Privacy;
2) The public system of information and communication;

PART IV – Exercises (10 Hours):
1) Critical discussion based on the material provided by the teacher.

Didactic methods

The lectures, which will follow the order of the suggested manual, will alternate moments of critical discussion and further study on the basis of the material that the teacher will provide during the course.

The delivery of the teaching will be done electronically, through the direct streaming of the lessons.

The platform used for streaming is Blackboard Collaborate (https://sea-el.unife.it/el-dip/); the video recordings will be available for consultation only within the same platform; the slides and any further teaching material will be made available to students on Classroom.

Learning assessment procedures

The exam will take place only in the form of the oral test and electronically, on the Google Meet platform.
The teacher will communicate by e-mail to the students the access link to the virtual classroom at the closing of the registrations to the relative appeal.
The questions addressed to the student will be aimed at verifying the acquisition of the knowledge and skills described above, in the framework of "Training objectives".
The examination mark is the result of the average of the marks attributed to each of the answers provided by the student, unless it reveals gaps such that it does not allow the formulation of a positive vote.
For students attending the course, there will be a regulated unofficial appeal close to the end of the course.
