Training objectives

The Course aims to deepen the knowledge of the most relevant aspects of the Parliamentary Law. The study of the regulation on the internal organization and activities of the Houses of Parliament is carried out through the resolution of practical cases and issues on Parliamentary Law.

Knowledge
The Course aims to give to the students the main juridical notions and the tools to understand the political-institutional relationships that develop in Parliament and in Senate, and among them and other constitutional subjects.

Skills
The Ability to elaborate studied principles and rules, and to apply those acquired knowledges to real life cases; ability to interpret the judicial decisions (in particular the constitutional ones) concerning the Parliamentary law.

Prerequisites

Prerequisite: Constitutional Law. The appropriate knowledge of the main institutions of Constitutional Law; the ability to use adequate legal language, logical skills and legal reasoning.g.

Course programme

The aim of the Course is to study the legal system that rules the internal organization and activity of the Houses of Parliament. The most relevant issues of Parliamentary Law are analyzed: namely, the polling system of the Houses, the guarantees of autonomy of the members of Parliament (immunity in force of par. 68 Constitution), the sources of Parliamentary Law (regulation and procedures), the internal organization of the Houses and the role of minorities.

Didactic methods

The Course will be focused on the relationship between Parliament and the Constitutional Court. A lot of Constitutional Court’s decisions will be analyzed and discussed in order to provide a practical approach to the subject. For students attending classes, learning materials will be provided by the professor.

Learning assessment procedures

Oral examination.
For class attending students the exam will include questions about cases and Constitutional Court’s decisions analyzed in class.
The students who will not attend the course have to prepare for the exam using the directions shown in the “REFERENCE TEXTS” section of this page.
