Training objectives

The course aims to provide students with the necessary foundations for understanding the most common legal institutions in the professional practice of the professional educator. During the course, students will learn to recognize and seek the sources of law and to deal critically with complex legal texts. The knowledge of the main institutions and bodies that characterize the social and health services will be acquired both through a traditional approach and by study of concrete cases. Students will be required to actively participate in lessons, in order to stimulate learning about the functioning of legal institutions and to develop a critical approach to the study of law.
At the end of the course the student will be able to:
• seek and recognize the sources of law, know the content of the Constitution and understand the meaning of legal norms;
• distinguish state institutions and their respective functions;
• be aware of the regulatory context relating to the health and social services sector, understanding its fundamental principles;
• identify the organizational models of the national health system and social services and the related responsibilities of the public apparatuses on a legislative and administrative level;
• understand the role of public administrations and non-profit organizations, in the provision of health and social services;
• identify the basic rules of the most relevant sectors of intervention.

Prerequisites

There are no prerequisites.

Course programme

The course is divided into two main parts.
Each topic will be addressed by combining the theoretical presentation with the discussion of some concrete cases.

A. The first part will focus on some preliminary legal notions and the study of the legal system, with regard to the sources of law, constitutional bodies and public administration.
Particular attention will be paid to the study of fundamental rights in the social and health sector, according to the following layout:
1. Introduction. The legal system, the sources, the Constitution and social rights. The right to health and social assistance. The rights of the person.
2. The sources of health and social assistance law. The legislative competences and the essential levels.
3. The health system and the organization of the health administration.
4. Social services and socio-health integration

B. The second part will deal with the study of the most relevant special laws in the social-health sector.
In particular, the following issues will be taken into consideration: informed consent; disability and law; principles of immigration law; hints on the discipline of adoptions, etc.

Didactic methods

The course will mainly be organised in frontal lectures. Students are required to actively participate and intervene in the discussion of practical cases. Theoretical topics will be explained through examples taken from current events.

Learning assessment procedures

Written exam. The exam is based on lectures notes and on the recommended materials. The Written exam consists of 2 questions.
