Training objectives

The main goal of the course consists in providing the knowledge of the basic elements of Roman Private Law: family law, ownership and other rights in rem, obligations and successions, the trial.

The main acquired knowledge will be:

- The evolution of private law in the course of the History of Rome
- The origins of modern private law
- Concepts and categories of private law

The basic acquired abilities (i. e. the capacity of applying the acquired knowlwdge) will be:

- The skill in understanding the evolution of law in its historical development
- The skill in understanding the most important concepts regarding the study of private law

Prerequisites

Good knowledge of Italian language, sufficient skills of reasoning and learning abilities. The knowledge of Latin makes the learning easier, but it is not mandatory.

Course programme

The course forecasts 60 hours of teaching. It analyzes the historical evolution of Roman Private Law from the origins to the Justinian age:
- Subjects of law: legal capacity and capacity to act (2 hours)
- Legal facts and acts (10 hours)
- Family law: freeborn, citizen and slaves, the Roman family, marriage, the father’s power (6 hours)
- Ownership, possession other rights in rem (14 hours)
- Successions: testamentary succession, legacies, trusts, intestate succession (6 hours)
- Obligations: the nature of obligation, general features of contracts, atypical contracts, agreements, quasi-contractual obligations, quasi-offence law, warranty obligations, discharge of obligations (16 hours)
- Roman civil trial (6 hours)

Didactic methods

The course will cover all the topics of the program. During the frontal lessons slides will be utilized. The slides, which are additional didactic materials, are available on line.
The course will be delivered in person, according to the calendar published on the website of the Study Course. The recorded video lessons will be made available by the teacher in the Classroom of the course. Classroom code: 6xhxl3q

Learning assessment procedures

The exam consists of a oral test. The aim of the exam is to verify at which level the learning objectives previously described have been acquired. Students have to answer some questions on the topics regarding the course programme. The final evaluation is established in connection with the examination results.
