Training objectives

This class is an advance course of EU Law which takes place within the Jean Monnet Module "EU Specialized Judicial Protection", founded by the European Commission (http://www.giuri.unife.it/it/dipartimento/aree-di-interesse-1/modulo-jean-monnet-eu-specialized-judicial-protection/modulo-jean-monnet-eu-specialized-judicial-protection-EN).

The aim of this course is threefold:

1) grant, also through seminars held by distinguished speakers, advanced knowledge on the EU system of judicial protection, avoiding any overlap with the basic classes on EU Law;

2) improve the students' critical thinking skills both for the sake of elaborating personal opinions as well as analysing others' texts (judgments, essays, normative acts);

3) prepare students on the most updated and controversial topic in the field, in light of their subsequent career.

Prerequisites

Preparatory courses: EU Law.

Course programme

The course forecasts 40 hours of teaching and is divided into two main parts.
The first one introduces to the general topic and analyses the EU system of judicial protection as a whole (CJEU, national Courts, EU agencies' Boards of Appeal, possible evolutions of the system).
In the second part, specific topic will be dealt with; they will be chosen by the professor year by year among the most important and interesting ones, also taking into account the participants' interests.
By way of example, topics may be the political role of the EU Court of Justice and its legitimacy; the standing of private parties before the CJEU; the protection of the rule of law; the relations between the CJEU and national constitutional courts; the rise of EU soft law and its justiciability.

Didactic methods

Classes will be held according to three teaching methods:
- in the first part, classes will be conducted by the Professor as seminars;
- in the second part, students will discuss judgements, essays or normative acts received well in advance, so as to improve their critical thinking;
- during both the first and second part, some classes will be held by distinguished speakers (judges, legal clerks, member of the EU institutions, Professors) so as to bring in the discussion also the practitioners' perspective.

Learning assessment procedures

The exam consists in drafting a paper that focus on issues debated during classes.
However, the student's participation in the whole course will also be taken in due account.

None. Attending these classes is mandatory and the exam can be studied only on the teaching materials given by the Professor.
