Training objectives

The course has two aims. The first is to complete the study of Private Law, to address those areas that had not been treated in the course of Institutions of private law: Family Law and Inheritance Law.
The second is to focus on the Family Law, in relation with which the students will gain a new and more critical method of study that will be developed through seminars and discussion of case law.

Prerequisites

Students are required to have a good knowledge of the principles and fundamental rules of Private Law - especially the Law of Obligations and the Law of Contract - and the sources of the Italian Law.
In addition, they are required to know the structure and the contents of the Italian Civil Code.

Course programme

Lectures and exercises will deal with italian Family Law.
1) Marriage and its effects: invalidity of the marriage; separation and divorce; matrimonial property regimes;
2) Civil unions of same-sex couples; Rules applicable to cohabitant couples.
3) Filiation: filiation of the parent-child relationship within a marriage and outside marriage; adoption; parental responsibility.
It is required to have an update Civil Code (with the Constitution, the EU Treaties, the EU Charter of Rights, the ECHR and the main special laws).

Didactic methods

The course is devoted to the analysis of Family Law and will address some problematic issues of this field of Private Law, related to the development of the national legislation, to the role of the Italian and European courts as well as to the influence of European and international law recent legislative reforms.
Seminars will be organized in addition to lessons: case studies will be used and students will have to solve them with written papers or as part of discussions.

Learning assessment procedures

The exam consists of a written test and an oral examination.
In the written test, the student is called to face and solve a case related to the field of the Family Law. The oral examination - to which the student always has the right to access, regardless of the evaluation of the written examination - tests the knowledge and in-depth understanding of the Family Law and the institutional knowledge of Inheritance Law. The final mark is the result of the sum of the one obtained in the written test (for 1/3) and the oral exam (for 2/3).
The study and comprehension of the Private Law requires the knowledge of the rules laid down by the Civil Code and the relevant Statutes: it is therefore recommended a constant and careful consultation of the Civil Code and the most important Statutes. In this regard, the knowledge of the structure and content of the Civil Code and the main Statutes as well as the ability to use them will be verified during the oral examination.
