Training objectives

The course aims at the knowledge of the organization of the Italian regional system, and particularly of its relationship with the State organization. Knowledge: the Italian regional form of government in the context of the traditional dichotomy of federal States and regional states; fundamental principles of Italian regionalism; outline of the regional organization and of the relationship with the State; above all, the allocation of normative competences between State and Regions, taking into account and deepening the subjects already dealt with during the course of constitutional law, particularly in light of the constitutional jurisprudence. Skills: the student is given the ability to interpreting and applying the constitutional rules to the Italian regional system in light of the executing legislation.

Prerequisites

The student shall already have good knowledge of the Italian constitutional law, in particular referring to the general principles of sources of law and State organization. Furthermore, a good practice capacity with regard to the normative and jurisprudential sources of law is required. Propaedeutic exams: Constitutional Law; Italian Private Law.

Course programme

The first, more general part of the course outlines the regional form of government being in force in our legal system, the regional state organization and the fundamental principles presiding over the relationship between the State and the Regions (unity and independence, subsidiarity, fair collaboration) – 20 hours. The second part of the course will be a seminary – 20 hours.

Didactic methods

During the lectures, the single subjects will be discussed starting from the single constitutional rule, which will then be interpreted pursuant to the executing legislation and the constitutional jurisprudence. The objective of the course is to illustrate the single arguments by getting the student used to reflect with method about the interpretation of the single law rules. The seminar requires an active participation of the students

Learning assessment procedures

The final exam consists of an oral test (about two question). Those students who will not attend the course have to prepare the exam using the indications in the "REFERENCE TEXTS AND MANUALS" section of this page.
