Contenuti e programma del corso fino all'a.a. 2014/2015 INTERNATIONAL TRADE LAW (40 HOURS, 6 FTE). Traders who are involved in international transactions are confronted with two legal regimes. The first governs the commercial relationship between traders, whereas the second regards the regulatory relationship between state actors and traders. The aim of this course is to provide students with knowledge and understanding of both legal regimes. Part I of the course regarding international private transactions examines the laws of international sale of goods (CISG), transport, payment and insurance. Attention shall furthermore be paid to the standard trade terms (Incoterms); conflict of laws in international trade; arbitration and conciliation. The public law part (Part II) analyses in particular the rules laid down in the different WTO agreements, including the laws of tariffs and duties, subsidies and countervailing measures and anti-dumping. The course is taught trough lectures and seminars. The latter places emphasis on the practical application of the law to various situations and invites students to prepare small (research) assignments to be discussed in class.
