Training objectives

Knowledge:
The reasons, the needs and the sources of the "Europeanisation" of criminal law and procedure.
The interactions between European law sources and national criminal law and procedure.
The features of the Area of Freedom Security and Justice under the Treaty of Lisbon.
The instruments and basic rules on extradition and mutual recognition in criminal matters.
The interplay between EU cooperation in criminal matters and Human Rights protection.

Ability
To understand the reasons and needs underlying the process of harmonization of national criminal laws.
To spot and assess the mutual influence between European law sources and national criminal law.
To argue, distinguish or decide criminal law cases on the basis of European sources.

Prerequisites

Italian Constitutional Law and European Union Law. General principles and institutions of the general part of criminal law (therefore Criminal Law I and II).

Course programme

The course consists of five part: I – EU administrative sanctions and their effect on national criminal system; II – The interaction between EU law and national criminal system; III – The EU third-pillar as from the Treaty of Maastricht; IV – The role of the ECJ case-law in the attribution to the EC of a criminal law competence; V – The EU competence in criminal law after the Treaty of Lisbon and its effect on national criminal system.

Didactic methods

During the course, the Europeanisation process of criminal law will be analysed in the light of the different doctrinal approaches and of the case-law of the Court of Justice, of the Constitutional Court and of the ECHR. The scrutiny on the impact of EU law on Italian criminal legislation will be carried out also on the basis of the current debate on the constitutional limits to European integration and of the related case-law. In the last part of the course, seminars will be organized on practical case or on the most recent developments of EU integration in criminal matters, as like as the reflects of the European Charter of Fundamental Rights on criminal law.

Learning assessment procedures

Oral exam. The students are required to illustrate: the constitutional problems stemming from the attribution to the EU of a legislative competence in the criminal law field; the interactions between EU law and national criminal law; the contents and scope of application of Framework Decisions and Directives in criminal matters and the related national laws of implementation. Attending students shall also address practical cases.
