Training objectives

The course will focus on the International, EU and domestic rules regulating immigration towards the EU. Students will get acquainted with the rules governing the conditions of entry, stay and removal of economic or forced migrants who are third country nationals.

The analysis and classroom discussion of relevant case-law and of some case-studies will encourage the development of a critical approach to the topics addressed during the course, allowing students to mature their own key to understanding highly topical issues.


Students who have not yet passed the exams of Constitutional Law, Institutions of Private Law and European Union Law will not be admitted to sit the exam.

Course programme

INTRODUCTION (4 hours): International, EU and domestic rules governing immigration. Citizenship and statelessness under International Law. State sovereignty and international obligations concerning entry, residence and expulsion of foreign nationals. FORCED MIGRATION OF THIRD COUTRY CITIZENS (22 hours): International and EU rules on the protection of refugees and asylum seekers, trafficking in human beings. VOLUNTARY MIGRATION OF THIRD COUTRY CITIZENS (14 hours): visa policy of the Schengen area, entry and free movement of migrant workers/students within the EU, family reunification, the international protection of migrant workers, status of long term residents, expulsion of third countries’ citizens, the fight against irregular immigration.

Didactic methods

1. Lectures (34 hours), with the support of slides and other teaching materials uploaded online. Students of the Laurea Magistrale in Giurisprudenza of the Ferrara campus may attend this lectures remotely, using the e-learning platform developed by se@. Further info will be given during the first lecture, which interested students are strongly advised to attend personally;
2. Seminars (3 hours). Two seminars will be devoted to the analysis of relevant case-studies. Students will be provided with the details of each case during the course. Working in small groups, students will be asked to provide a solution for the case, taking the side of one of the parties involved.
3. Workshop (3 hours + 10 hours of preparation at home): the workshop will involve a simulation of the procedure to be followed when applying for asylum. Students will be divided in two groups. One group will support the asylum seeker, the other will play the role of the territorial commission. The first group will be called to write a brief supporting the request and will prepare the asylum seeker for the interview. The second group will conduct the interview of the asylum seeker and will be called to write the final decision, granting or denying the international protection. The decision will then be discussed in class.

Learning assessment procedures

Students not attending classes:
Oral exam, aimed at assessing the achievement of the learning objectives stated above. Students will be called to answer a couple of questions relating to the topics covered during the course.

Students attending classes
- Oral exam (50% of the final mark)
- Evaluation of the workshop (50% of the final mark)

To pass the exam, students must score at least 18/30.

Students who attend classes may prepare for the exam revising their own notes and studying the texts included in the reading list published online.
